This is where we lay down the law. Or it's where our lawyers lay down the law, because that's what they're good at. If you've got a question about legal liability or safety while using the site, you'll probably find the answer here.
Parts of this website are 'Registered Member Areas'. You must register to become a 'Registered Member' before you can access the 'Registered Member Areas'.
Once you have given us this information, we will send a four-digit registration code to your mobile phone which you will need to complete the registration process. This helps us to keep the website secure.
By providing your mobile phone number you are agreeing to us contacting you by SMS text message, including for the purposes of providing you with your registration code and other communications we may wish to send you from time to time.
Registration on the website is at our discretion and we may refuse to process your registration without giving you a reason for doing so. We ask for additional information if you wish to register as a mentor.
If you do not have a UK mobile phone number, please contact us at firstname.lastname@example.org for help with registering on the website.
Use of this website
You must be 16 or over to register as a Member. If we suspect that you are under 16, we will cancel your registration and you will not be able to use the Registered Member Areas of the website. If you are under 18, you must have a parent or guardian’s consent to use the website.
This website is for the personal use of individuals in the UK only and may not be used for any commercial endeavours.
horsesmouth is an online community which is built on allowing people to share experiences in a way which is secure and confidential. It is not for dating, seeking professional advice or promoting commercial activities. You should not arrange to meet other members of the horsesmouth community in 'real life'.
At horsesmouth we think what you have to say is more important than what you look like. For this reason, and also to maintain security and anonymity, we do not allow you to upload any photographs or other images onto the website. When you use the site you should avoid using or disclosing in any way your name and any personal details by which you could be identified (including your address, telephone numbers, email addresses etc.) or the names or personal details of others. You should identify yourself only by your username. We strongly advise you not to include your real first name in your username. For your own protection we also strongly advise you to avoid giving out any financial information (such as bank account details or credit card numbers) on the website.
Only you may use your username. You must not disclose your registration code or password or allow anyone else to use your username on the website. You should address other members only by their username.
If someone attempts to send you their own or someone else’s personal details, you should alert our team immediately by emailing: email@example.com.
The principle of anonymity is to protect members of the website. We cannot accept any liability for any loss or damage you may suffer as a result of you revealing your identity or other personal details when using the website.
horsesmouth exists to allow and encourage people to share their life experiences. Conversations and postings made by Registered Members are at the heart of this.
However you must ensure that there is nothing in your conversations which is or might be regarded as harassing, threatening, abusive, vulgar, obscene, defamatory, racist or otherwise unlawful.
There are two levels of transmission and publication of your conversations which can take place on the website. Initially any conversation will be between Registered Members of the website ('Unpublished Conversations'). At any stage during an Unpublished Conversation, you may agree with the person you are communicating with to publish the Unpublished Conversation. If you both agree to publish an Unpublished Conversation, we may publish part or all of the string of emails which make up that conversation (or an edited version of them) on areas of the website accessible to other Registered Members and to other users of the website. In these Terms we call these conversations 'Public Conversations'.
By creating a Profile when you become a mentor on the website you thereby assign any copyright you may have in your Profile to us (including any updates you may make to your Profile from time to time). By agreeing to publish a conversation, you thereby also assign your copyright in that conversation to us. We may publish Public Conversations and Profiles on the website or in any other media and may also grant licences to third parties to re-produce any Public Conversations.
We reserve the right to review, store, copy, edit, reject, block, delay, suspend, remove or delete both Unpublished Conversations and Public Conversations at any time and at our sole discretion. You waive and agree not to assert any so-called moral or similar rights (whether arising under the Copyright Designs and Patents Act 1998 or otherwise) you may have in any Unpublished Conversations or Public Conversations that you make. This includes waiving the rights to be identified as the author of and to prevent derogatory treatment of the conversations.
Transmitting Unpublished Conversations to the other Registered Members who are part of those conversations and publishing Public Conversations is at our discretion. We cannot guarantee if or when Unpublished Conversations will be transmitted or Public Conversations published or in what form. We will not usually provide a copy of any Unpublished Conversations to anyone except the other Registered Member(s) to whom the Unpublished Conversation is addressed. However, in exceptional circumstances we may provide a copy of an Unpublished Conversation to an appropriate and responsible third party if we consider it necessary and appropriate to protect someone from suffering serious harm or injury. By conducting any Unpublished Conversations through the website, you grant us a licence to use and copy the Unpublished Conversations for these purposes.
You warrant that your conversations or any use we may make of them under these Terms and Conditions will not:
• violate the rights of or harm or threaten the safety of any person;
• infringe the copyright, trademarks, rights of privacy, publicity or other intellectual property or other rights of any other person or entity;
• contain malicious code, such as viruses, worms, Trojan horses or other potentially harmful programs or material; or involve the transmission of junk mail, chain letters or unsolicited mass mailing ('spam');
• be likely to deceive any person;
• contain offers of any goods or commercial or professional services or any requests or offers of financial aid;
• be made in breach of any legal duty owed to a third party, such as a contractual duty or a duty of confidence;
• violate any applicable law, statute, rule or regulation.
Any Registered Member can block another Registered Member from addressing content to him or her and/or viewing his or her profile. However, please alert our team by e-mailing firstname.lastname@example.org if you feel uncomfortable with any conversations which another Registered Member addresses to you. You should avoid replying to offensive language from others.
Our mentors are Registered Members who have also registered as mentors and who offer to give their time and share their experiences for the benefit of others. Please bear in mind that unlike most professional experts, our mentors will not have had the opportunity to meet you or conduct the sort of thorough and detailed assessment of your specific circumstances that is necessary to provide you with advice that may be relied upon. Because we facilitate anonymous sharing of information and experiences, our mentors will not know who you are. They will only know the information provided in your Registered Member profile. Therefore, while we hope that you will find their answers helpful, they are not intended to be the only answer or the 'right' answer for your specific circumstances. Often the 'right' answer will vary from person to person, depending on facts outside of our and our mentors' knowledge and contemplation. We encourage you to use the mentor-rating system provided by the website to give feedback about mentors.
Our mentoring service is a free information service and is not intended to replace or substitute for the services of professional experts but rather to allow Registered Members the benefits of shared experiences. Any information received through this website does not and should not replace professional advice. In particular, you should always consult a doctor promptly in all matters relating to physical or mental health, particularly concerning any symptoms that may require diagnosis or medical attention.
